In July 2022, the Supreme Court upheld a Court of Appeal judgement that staff on term time-only contracts should receive at least the same statutory holiday pay as full-time workers, which is 5.6 weeks per annum.

In Welsh FE Colleges, this judgement has implications for the way holiday pay is calculated for a wider group of staff: part-time and hourly paid as well as term time-only staff.
The joint further education trade unions in Wales are currently working with FE employers to ensure that annual leave is calculated in line with this judgement and that past shortfalls are paid.
